OFFICIAL CONTEST RULES
LINUX PROFESSIONAL INSTITUTE
Linux Professional Institute (LPI, the “Sponsor”) holds Contests for various purposes. This document explains the rules and regulations for these Contests.
Announcement
Each individual Contest shall require an Announcement in the form of a publicly-available document or web page that is accessible during the Contest Period. The Announcement will describe, at minimum:
- The name of the Contest
- The prize(s) to be offered
- The Contest Period start and end dates
- The Method of Entry
Eligibility
Contests are open to legal residents of Canada and other jurisdictions, excluding anywhere such Contests are prohibited or restricted by law, who are over the legal age of majority in their jurisdiction of residence, as of the end of the Contest Period. Employees of the Sponsor and affiliate companies, representatives and agents, as well as the immediate family members and those living in the same household of any of the above are not eligible. Limit one (1) entry per person per Contest, and one (1) prize per person. In the event that the Sponsor receives more than one (1) entry from the same entrant for a Contest, the Sponsor will void the duplicate entries. In the event of a dispute over the identity of an entrant, the authorized account holder of the email address will be deemed to be the entrant.
Residents of the following jurisdictions, and others where local registration of Contests is required, are not eligible:
- Iran
- North Korea
- Russia
- Serbia
- Quebec, Canada
- Florida, USA
- New York, USA
- Rhode Island, USA
- Crimea Region, Ukraine
Contest Period
Contest Periods will vary based on the specific contest(s) being offered and will be expressly detailed within the Announcement.
No Purchase Necessary
No purchase or payment of any kind is necessary to enter or win a Contest. Purchases will not improve the chances of winning.
Method of Entry
The Method of Entry will vary depending on each individual Contest and will be described in its Announcement.
Submitted Entries will not be judged, however the Sponsor reserves the right to delete and/or exclude any inappropriate, incomplete or irrelevant entries, as determined in the Sponsor’s sole discretion.
Prizes and Odds
The quantity and value of prizes to be offered will be explicitly listed within the Contest Announcement.
No more than the number of prizes detailed in the announcement of the contest will be awarded. Prizes are not transferable, assignable, saleable or redeemable for cash or other substitutes. Other conditions may apply to prizes, such as time limits, which if applicable will be listed in the Announcement. All prizes are awarded “as is” with no guarantee, either express or implied. The Sponsor reserves the right, in its sole discretion, to substitute one or more elements of a prize for a prize of equal or greater value. The Sponsor will determine the appropriate method of shipment of prizes.
Odds of winning depend on the number of eligible entries received during the Entry Period.
Winner Selection
The Sponsor will conduct a random drawing from all eligible entries received during the Contest Period, within ten (10) business days of the end of the Contest Period. The Sponsor will notify selected entrants by email using the same email address used by the selected entrants to enter the Contest. Selected entrants are responsible for providing an accurate email address to the Sponsor.
Once the notification is sent, each entrant has two (2) months to contact the Sponsor to claim the prize as directed in the notification. If a selected winner is found to be ineligible, does not or cannot comply with these Official Rules, does not respond within two (2) months, or if the prize notification is returned as undeliverable, the selected winner will be disqualified and the prize forfeited.
To be declared a winner, selected entrants must correctly answer a time limited mathematical skill-testing question, without assistance of any kind, whether mechanical or otherwise, to be administered by email.
Declaration and Release Form
By entering this Contest, entrants agree to abide by and be bound by these Official Rules. Selected entrants agree to release, hold harmless, indemnify and defend the Sponsor and its respective officers, directors, employees and representatives (the “Released Parties”) from any and all liability relating to the Contest (participation, conduct, advertising, rules, etc.) or the acceptance or use of a prize. Entrants agree to assign all copyrights and waive all moral rights for any or all of the content of their Contest Entry to the Sponsor. By accepting a prize, winners grant to the Sponsor the right to use their name, location, job title, and any or all of the content of their Contest Entry for any lawful purpose (including but not limited to advertising and promotion), in perpetuity, in any media now known or hereafter developed, without further permission or compensation.
Selected entrants may be required to sign a Declaration and Release Form confirming their compliance with these Official Rules and a release of liability in favour of the Released Parties in advance of receiving prizes. If the Release is refused or not returned in completed form within two (2) months of notification, the prize will be forfeited.
Limitation of Liability
To the fullest extent permitted by law, the Released Parties assume no responsibility or liability for (a) any incorrect or inaccurate registration or entry information, or for any faulty, failed, garbled or jumbled electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Contest; (c) any late, lost, undeliverable, or stolen entries; (d) any printing, typographical, technical, computer, network, shipping or human error which may occur in the administration of the Contest, in the announcement of the prizes or in any Contest-related materials; (e) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of the Contest; (f) any inaccessibility or unavailability of the internet; or (g) any injury or damage to entrant’s or to any other person’s computer which may be related to or result from any attempt to participate in the Contest.
General
Contests is subject to these Official Rules and to all applicable laws of Ontario, Canada. Contests are void in any jurisdiction where they would be prohibited or restricted by law.
Privacy
Information collected from you is subject to the Sponsor’s Privacy Policy, available at http://www.lpi.org/policies, under “Privacy Policy”. Notwithstanding the foregoing, by entering the Contest, entrants agree to the collection, use, and disclosure of their personal information for purposes related to the administration of this Contest and for any other communications purposes for which valid consent is obtained.
